Bajan Digital Creations Incorporated (“us”, “we”, or “our”) is the operator of this website and the artificial conversational entities that bear our signature (the “Service”).
This page informs you of our policies regarding the Service we provide to the User (“you”, “your”, “user”) when you visit, use or refer directly our Service.
“Our Service” means any application, good, subscription, or information that is solely and directly controlled or operated by us. This includes:
- Referral to third party site via link.
- Referral to third party site via application.
- Download of legally acquired copyrighted content.
- Access to legally acquired copyrighted content.
- Transactions involving tangible goods.
- Any adjustment to the Service that we determine is in the User’s best interest, our interest or as required by law.
“Use” means view, enjoy and interact with. It does not mean the ownership of any digital good.
“Good(s)” means any purchasable item or service that is exclusive to Bajan Digital Creations Inc.
“Transaction” means you have paid us in exchange for the use of a good via a mutually approved legal process.
“Purchase(d)” means that the transaction and the appropriate documentation have been completed.
“Legitimate means” shall be interpreted as subscription or legal purchase by the user.
“Subscription” means a defined and agreed period of unlimited access to our service.
“Order(ed)” means that your intent request has been documented, we are in control of the request but the transaction is incomplete.
“Ship(ped)” means that the request is no longer in our control, documentation is complete but the transaction is incomplete.
“Referral” means the suggestion of a third-party service provider to the user.
User
You have the role and title of User and there is no expressed or implied ownership on your part to any digital good or service. All digital goods are subject to copyright and remains, in perpetuity, under the ownership or custody of Bajan Digital Creations Incorporated. Your purchases and subscriptions are for licensed use to view, enjoy and interact with our digital content. In short, you pay for a single licensed use of content and that license is not transferrable to any agent.
User Responsibility
The user agrees that they will not:
- Engage in illegal or unethical use of this site
- Make the experience of other users onerous or unpleasant
- Tamper with, de-compile or duplicate any content on this site
- Use bots to interact in any way with this site, including but not limited to: uploading, commenting or placing orders
- Refer, share or use any part or whole of any content on the Service without crediting the Service as the source of the content.
- Request, seek to procure, copy, steal, de-compile, augment, or edit any source code, protocol, script, code, content or information that forms part of or wholly the Hiyaro application.
Referral
Our Service may suggest third party providers to you as part of the fulfillment to queries posed by you the User. We are not to be held liable for the accuracy of that suggestion. This suggestion is based on: the accuracy of third party data, the nature of your query, the context in which you made the query and general usage patterns. We are not liable for your activity, use, visit or interaction with any third-party service that you initiate. By using our referral Service, you are agreeing to these terms and also agree that you will not hold us liable for any damage, injury or loss you, your property or agent incurs in the activity, use, visit or interaction with any third-party service.
Download and Access
Our Service may allow you the use of purchased, copyrighted content under the following terms:
- That the Service has been accessed via legitimate means.
- That you are in good financial standing with us.
- That you do not resell, use, distribute, de-compile, edit, augment, duplicate any copyrighted content without the written permission of Bajan Digital Creations Inc.
- That you do not by action or inaction, intentionally or unintentionally disrupt the functioning, delivery or management of the Service.
- That you do not deliberately or unintentionally provide information that is inaccurate, misleading or intended to deceive us or our agents.
- That you are not engaged in any terrorism, illegal drugs, human trafficking, illegal trade, money laundering, animal trafficking, cyber-crime, public acts of intolerance or behavior as deemed unreasonable or unacceptable to the greater good.
We reserve the right to change our Service at any time without prior notice to an unsubscribed user.
Ordering and Return Policy:
We do not request credit card information.
Order cancellation:
In the rare event that an ordered item has become unavailable after it has been checked out, we will refund you the cost of that item.
If it comes to our attention that you are in breach of our terms of service after your order has been processed but not shipped, we will refund you only the cost of the items and will immediately terminate all Service to you.
If it comes to our attention that you are in breach of our terms of services after your order has been processed and is shipped (including in transit), you will not be refunded and all warranty shall be void your complete order.
You take full responsibility for the check-out process. Should you decide to cancel an order after you have checked out, please contact us within 12 hours of your checking out. Depending on the nature of your order we may not be able to cancel the order for any or all items. Should we be able to cancel your order after check-out, you will only be refunded the cost of the unshipped item(s).
Refund on Goods
There is no refund on downloaded or downloadable digital goods. By using this service, you are agreeing that we will not be held liable for any injury, damage or loss incurred by you, your property or your agent. We ensure that our downloadable content is secure and free of malware and spyware. However, because this content is hosted on servers that are not totally in our control and you access this data via networks we do not control (your ISP, etc.), we can never guarantee the absolute integrity of a downloaded file.
You may return a purchased good, in accordance with the warranty of that good, provided that you are willing to pay for the shipping and handling to Barbados. Once we receive your purchased item in addition to your correspondence and have verified your claim in accordance with the warranty of the item, we will either
- Refund you the cost of the item.
OR
- Replace your good at no additional cost to you.
We will NOT refund, replace or reship any purchased good whose warranty has expired or has been made void by unrecommended use, inappropriate use or abuse. We will not refund, replace or reship any purchased good that we have reason to believe has been used, linked, has evidence of or otherwise connected to any terrorism, trafficking, illegal or criminal activity.
Subscription Adjustments:
We and you may adjust subscription services in accordance with our subscription cycle. You may not resell, lease, transfer or clone your subscription at any time. Automatic termination of service will occur at the end of a subscription cycle unless you renew your subscription. Renewal of subscription is an indication that you agree to the terms and conditions associated with that subscription cycle. Your subscription may also be terminated without notice, should we discover you are in breach of our terms and you may be barred from subscription at our discretion. We reserve the right to make adjustments to the Service and will communicate any adjustments to all affected subscribed users. We shall not be held liable for any denial of subscribed services in the event of:
- Power outages.
- Natural disaster.
- Government Legislation.
- Cyber-attack.
- Any action we must take to protect public interest, our interest, national security, network infrastructure, maintenance, the well-being of subscribed users or the compliance of Bajan Digital Creations Incorporated with rule of law.
Changes to this Terms of Service Policy
We may update our Terms of Service from time to time. We will notify you of any changes by posting the new Terms of Service on this page.
We will let you know via email and/or a prominent notice on our Service, prior to the change becoming effective and update the "effective date" at the top of this Terms of Service.
You are advised to review this Terms of Service periodically for any changes. Changes to this Terms of Service are effective when they are posted on this page.
